Here are some of the employment law changes that have come into place from April 2023.
The national minimum wage rates will increase from 1 April 2023 as follows:
- National living wage (workers aged 23 and over): increase from £9.50 to £10.42
- Standard adult rate (workers aged 21-22): increase from £9.18 to £10.18
- Development rate (workers aged 18-20): increase from £6.83 to £7.49
- Young workers rate (workers aged 16 and 17 who are not apprentices): increase from £4.81 to £5.28
- Apprentice rate (apprentices under 19 or aged 19 or over and in the first year of apprenticeship): increase from £4.81 to £5.28
Statutory maternity, adoption, shared parental, paternity and parental bereavement pay will increase from £156.66 to £172.48 per week from 2 April 2023.
Statutory sick pay will increase from £99.35 to £109.40 per week from 6 April 2023.
The Employment Rights (Increase of Limits) Order 2023 has been published.
This sets out the annual increase in tribunal compensation limits.
Key increases for people to take note of are:
• Compensatory Award: £105,707 (previously £93,878);
• A ‘week’s pay’ (for basic award and redundancy payments) - £643 (previously £571).
The changes take effect for dismissals from 6 April 2023.
The eagle-eyed amongst you will note that the increases are more than usual this year. This goes some way to addressing the fact that over many years the increases have not kept up with wage growth / inflation.
The latest Presidential Guidance on Employment Tribunal awards for injury to feelings and psychiatric injury has been published.
In respect of claims presented on or after 6 April 2023, the “Vento bands” shall be as follows:
• a lower band of £1,100 to £11,200 (less serious cases);
• a middle band of £11,200 to £33,700 (cases that do not merit an award in the upper band); and
• an upper band of £33,700 to £56,200 (the most serious cases), with the most exceptional cases capable of exceeding £56,200.
